Learning goals

90-minute seminar

  1. 10 minutes: Recall the assigned reading and define the decision to be made.
  2. 20 minutes: Discuss the reading guide and test its distinctions against the text.
  3. 25 minutes: Work in pairs on the constructed exercise, recording missing evidence.
  4. 20 minutes: Compare reasons with the facilitator commentary and challenge an inference.
  5. 10 minutes: Debate the challenge question using a specified rule or evidence gap.
  6. 5 minutes: Complete the exit task and identify a source to revisit.

Reading guide

The origin inquiry follows the value’s acquisition, currency conversion, remittance, declared purpose and actual use. Personal identity is insufficient to reconstruct that route. A single premium can combine legally different tranches, so the insurer’s aggregate receipt does not answer every origin question. The chapter also distinguishes the functions of legislation, administrative material, forms and bank processing. A successful transfer records an operational event on the information then supplied. It does not settle every issue of accuracy, lawfulness or later effect. Any Hong Kong consequence requires the relevant rule and procedure to be identified separately.

Fictional classroom exercise

A fictional premium is funded 50% from documented offshore earnings, 20% from pre-held foreign currency in a Mainland account and 30% from a new currency purchase. Only the final tranche has a purpose description apparently inconsistent with the insurer receipt. Design a document request and state three separate provisional findings. Do not assume the source percentages establish beneficial shares in the policy.

Facilitator commentary

Request the source account history, acquisition record, relevant purchase or remittance form, supporting documents, bank communications and receipt for each tranche. Preserve the distinct routes. The inconsistent description is a reason for a focused inquiry, subject to clarification and the applicable rule. It does not establish a concluded breach or invalidate the whole policy. Identify the competent authority, relevant time and any cross-system route before stating a consequence. These percentages are invented for this seminar and differ from the book’s recurring example.

Challenge for discussion

When is aggregation legally justified, and which additional facts and rule would support it?

Exit task

Explain in 100 words what a payment-processing record proves and what remains unresolved.
